The Operating Procedures for the Delaware Judicial Branch, Section VII(1), authorizes the presiding judge of each court to determine whether electronic media coverage of ””non-jury, non-confidential proceedings”” can be allowed on a discretionary basis. Delaware Superior Court prohibits all use of electronics for any purpose by media personnel, and written permission can only be requested for a laptop or tablet that would be used for note-taking purposes during a non-jury, non-confidential proceeding. Delaware Superior Court Civil Rules do not address media coverage, but Rule 53 of the Delaware Superior Court Criminal Rules, Rule 53 of the Delaware Family Court Criminal Rules, and Rule 53 of the Criminal Rules of Delaware Courts of Justices of the Peace prohibit electronic coverage except by Section VII(1) or other rules adopted by the Delaware Supreme Court.

Personal electronic devices, like cell phones, are prohibited in many Delaware courts.  For example, in Superior Court and Justice of the Peace courthouses, all electronic devices are prohibited, including cell phones, PDAs, and notebooks.  In Sussex County, Kent County, and New Castle County courthouses, all personal communications devices, like cell phones with cameras, are generally prohibited from the courtroom, and only authorized individuals may bring these devices into the courtroom.

Delaware Supreme Court proceedings are livestreamed with video and audio recordings archived and available to the public.
